Economic activity in Poland

 

If you are a foreigner and you want to undertake an economic activity in Poland, please note, that it is a  legal form that depends on the basis of the type of your stay in Poland. It means that if you want to start a business on the same basis as Polish citizen (self-employment/conduct individual business activity), you should:

  • be a permanent residence permit holder;
  • be a long–term EU–resident permit holder;
  • have a refugee status or a subsidiary protection;
  • have a humanitarian or tolerated stay;
  • have a temporary protection;
  • have a temporary residence issued on the basis of:

– studies;
– scientific research
– family ties;
– other circumstances within the meaning of art. 186 paragraph 1 points 3, 4 i 7 of Act on Foreigners from December 12, 2013 (Journal of Laws of 2020, item 35)

  • have a valid Pole’s Card;
  • be a temporary residence permit holder and married to a Polish citizen who resides on the territory of Poland
  • have a temporary residence permit for the purpose of conducting economic activity issued on the basis of continuation of an economic activity registered in CEIDG.
  • be family members within the meaning of art. 2 point 4 of the Act on the entry into the territory of the Republic of Poland, stay and exit from this territory of citizens of the Member States of the European Union and their family members from July 14, 2006  (Journal of Laws of 2019 item 293), who joining to the citizens of countries from Member States or staying with them,
  • stay in Poland on the basis of confirmation of submission of the application for a temporary residence permit or permanent residence permit or on the basis of a stamp in the passport which confirms that a foreigner has submitted an application for granting residence permit for EU long-term resident if directly before submitting the application the foreigner was entitled to undertake and conduct a business activity on the basis of the abovementioned temporary residence permits (exception: temporary residence permit for the purpose of conducting economic activity issued on the basis of continuation of an economic activity registered in CEIDG)

 

Unfortunately, if you do not have one of the mentioned permits, you can conduct an economic activity in Poland only by registering a company in the following forms:

  • Limited liability company,
  • Joint-stock company,
  • Limited partnership,
  • Limited joint-stock company
