Child born in Poland – how the number of days in visa-free regime should be counted

It happens really often that a child of third-country nationals, e.g. Ukraine, is born in Poland. Then, Parents are wondering how the days of visa-free regime should be counted FOR THEIR CHILD.
The question is if the stay in visa-free regime counts from the day the child was born or when the passport is collected from the diplomatic post.

The answer: The stay in the visa-free regime of a child of third-country nationals counts from the day of his/her birth, as it is the first day of his/her stay on the territory of the Schengen Area countries.

It is important because if the child has been in Poland since the day of birth in a visa-free regime, then his re-entry into the territory of the Republic of Poland can only take place on the basis of a national visa to Poland (Type D), or by staying in the country of origin for 90 days, until the “renewal” of visa-free regime and re-entry on the basis of a biometric passport.
