New year brings new legal provisions concerning transportation services provided by the companies like Uber and Bolt. These provisions are established by the virtue of the new bill implementing changes in the act on road transportation and some of the other bills from 16th of May 2019 (Dz.U. z 2019 r. poz. 1180).
These regulations concern the above mentioned companies as well as individuals providing transportation services.
This amendment is introducing the notion of intermediation in transportation of passengers as a particular business activity where one entrepreneur deputes performance of the service (transportation of passengers) to another entrepreneur. This particular kind of activity includes concluding the agreement on behalf of the passenger and collecting the payment by the deputing entrepreneur.
This definition corresponds with activities of Uber and Bolt and they will be obliged to fulfill all duties imposed on them by this act.
The most significant, new obligations require acquisition of the legal license entitling to perform transportation of passengers by this companies and deputing this performance only to entrepreneurs who have the licenses entitling to perform transportation of passengers as well.
Until now, similar requirement embraced only taxi drivers while it did not cover Uber and Bolt drivers. Along with the implementation of these additional obligations, conditions which one has to meet in order to be granted this kind of transportation license will be mitigated.
Future drivers will not be obliged to prove their financial means and pass the exams to prove their knowledge of city’s topography and local laws.
The most crucial change seems to be that the acquisition of this license will be possible only for the entrepreneurs. This means that whoever will be willing to apply for this license will need to register their economic activity.
In addition, new provisions regulate accounting issues – payments for the transportation of the passengers will be possible with a mobile application, and sets out minimal requirements.
This application is meant to replace taximeters.
All the changes will have a huge impact on the transportation market. A good thing is, that entities preforming intercession in transportation of the passengers have three months to adjust to the new regulations.
